§ 2-111. Procurement code.

  • (a)

    Procurement code generally. Section 2-111—2-119 of this article shall be referred to as the city's "procurement code."

    (b)

    Purpose. The primary purpose of this procurement code is to encourage greater competition, ensure purchasing integrity and maximize the acquisition value of public funds while allowing for an efficient, flexible procurement operation.

    (c)

    Application. This procurement code applies to all city procurement of goods and/or services (including construction) and to the city's expenditure of public funds for such procurements regardless of the source of the funds. When the procurement involves the expenditure of federal, state or county assistance or grant funds, the procurement shall be conducted in accordance with any mandatory applicable federal, state and local laws and regulations. Nothing in this procurement code shall prevent the city from complying with the terms and conditions of any grant, gift, or bequest that is otherwise consistent with law.

    (d)

    Availability of funds.

    (1)

    Funds must be available in the annual adopted budget for all procurement of goods and/or services.

    (2)

    The user department director shall be responsible for the determination of availability of funds.

    (e)

    Equal opportunity . No person or business shall be excluded from participation in, denied benefits of, or otherwise discriminated against in connection with procurement by the city on the grounds of race, color, religion, sex, gender identity or expression, national origin, age, disability, familial status, marital status, or sexual orientation.
