§ 17-3. Court costs for law enforcement education and training.

  • (a)

    Generally. All courts created by Article V of the State Constitution shall assess two dollars ($2.00) as a court cost against every person convicted for violation of a state penal or criminal statute or convicted for violation of a municipal or county ordinance. However, such assessment shall not be imposed in addition to civil penalties provided in section 318.18, Florida Statutes. Any person whose adjudication is withheld pursuant to the provisions of section 318.14(9), Florida Statutes, or section 318.14(10), Florida Statutes, shall also be assessed such cost. In addition, two dollars ($2.00) from every bond estreature or forfeited bail bond related to such penal statutes or penal ordinances shall be forwarded to the finance director as described in this section. However, no such assessment may be made against any person convicted for violation of any state statute, municipal ordinance, or county ordinance relating to the parking of vehicles. All such sums shall be turned over to the finance director to be deposited in a fund established in subsection (b) to be known as the criminal justice education and training fund.

    (b)

    Criminal justice education and training fund. There is hereby established in the city a fund to be known as the criminal justice education and training fund. All funds received by the city from the assessment of court costs established in this section shall be deposited by the finance director in a fund to be known and designated as the "criminal justice education and training fund." Such funds may, from time to time, in the discretion of the city commission, be invested. The interest received upon such funds and the principal thereof may, upon the request of the chief of police of the city, be used for criminal justice education degree programs and training courses, including basic recruit training, for police officers and city support personnel the benefit of members of the police department. Expenditures shall be permitted by the finance director when authorized in accordance with the law.

    (c)

    Criminal justice training program. There is hereby established a criminal justice training program as provided in section 943.25(13), Florida Statutes. The details of such program shall be included in the police department policies and procedures manual and/or in other official documents issued by the chief of police, and such program shall be funded, in whole or in part, by the assessment of court costs established in this section.
