§ 5-4. Hours of sale.

  • (a)

    On-premises consumption . No person shall sell, deliver, consume or permit the sale, delivery, service or consumption of alcoholic beverages on the premises except for the following hours where a business holds a legal alcohol license: The hours of sale of alcoholic beverages of more than one (1) percent of alcohol by weight shall be from 12:00 a.m. (midnight) to 2:00 a.m., and 7:00 a.m. to 11:59 p.m., each day.

    (b)

    Off-premises consumption . No person shall sell, deliver or permit the sale or delivery of alcoholic beverages for off-premises consumption except for the following hours where a business holds a legal alcohol license: The hours of sale of alcoholic beverages of more than one (1) percent of alcohol by weight shall be between the hours of 7:00 a.m. and 10:00 p.m., each day, unless otherwise permitted under Florida Statutes.

    (c)

    Enforcement . A law enforcement officer authorized to enforce the laws of the state within the City of Lake Worth may enforce the provisions of this section, including through the issuance of a notice to appear. Any violation of any of the provisions of this section shall be prosecuted as a misdemeanor of the second degree and punished by a fine of not more than five hundred dollars ($500.00) and/or imprisonment in an authorized facility for not more than sixty (60) days. The remedy provided for in this section is not exclusive. The city may pursue any other legal or equitable remedies available under law, including without limitation, code enforcement.
