§ 21-40. Presumption of identity of violator.

  • In any prosecution charging a violation of this article for which a municipal parking violation has been issued to the registered owner of a vehicle, proof that the person accused was the registered owner of the vehicle at the time of the alleged violation shall create a rebuttable presumption as to the identity of the violator. The accused may be called by the prosecution to testify for the purpose of establishing such presumption. Such presumption may be rebutted by competent evidence.
