§ 15-24.8. Emergencies.

  • In case of emergency or urgent necessity, a construction contractor, other builder, or a communications company providing essential services or the city utility department may apply to the city manager for an exception of sections 15-24.6 or 15-24.7, and the manager shall grant the exception only if undue hardship would result from a denial. For purposes hereof, such an emergency or urgent necessity must arise from a natural disaster, act of God, an act or failure to act on the part of a third party not related to or under contract with the construction contractor or builder requesting the exception or an out of service or imminent out of service condition of utilities and essential services. Where the emergency is an out of service or imminent out of service condition of utilities or essential services, then the communications company providing such essential services or the city utility department may respond to such emergency in a timely manner and shall make such application to the city manager at the earliest time thereafter.
