§ 12-16. Dumpster requirements.

  • (a)

    Generally . The location of all dumpsters shall be approved by the public services director or his designee and the building official or his designee. All dumpsters shall meet the requirements set forth below and all rules, regulations and policies adopted by the city.

    (1)

    Dumpsters shall be screened by a masonry wall with plastered and painted surfaces, wood fence or chain link fence fitted with slat material approved by the building, planning and zoning department and where possible surrounded on three (3) sides by shrubbery. Such walls and fences shall extend to a height of at least six (6) inches above the top of the dumpster and gated vehicular access opening. The gate construction shall be sturdy metal frame with wood or approved slat material. The gate posts shall be a minimum four-inch diameter galvanized steel pipe filled with concrete. The gates shall be provided with wheels for easy mobility. Gate stops shall be provided to secure the gates in an open position, and a mechanism to secure the gates in a closed position.

    (2)

    Newly constructed dumpster enclosures shall be set on a reinforced concrete slab, six (6) inches thick. Existing pads shall be subject to approval by the building official.

    (3)

    Be a minimum of ten (10) feet deep by twelve (12) feet wide.

    (4)

    Be provided with a concrete service apron or curb cut if applicable six (6) inches thick.

    (5)

    Be provided with side and rear guides to ensure the dumpster does not damage the enclosure.

    (6)

    The concrete slab should have a two (2) percent slope. It shall be shaped as to drain in accordance with the drainage on site.

    (b)

    Maintenance .

    (1)

    All dumpsters and enclosures shall be kept in good and structurally sound condition as to be aesthetically pleasing to surrounding properties.

    (2)

    All dumpsters shall be kept in a sanitary, odor-free condition as not to cause a public health problem or nuisance.

    (c)

    Permit .

    (1)

    No person shall construct or enclose a dumpster without first obtaining a permit therefor.

    (2)

    Application for a permit under this section shall be made to the building official and shall be accompanied by the payment amount specified in the city's schedule of fees and plans and specifications sufficiently detailed and drawn to scale. The plans shall include its exact location on the property, the access to it, enclosure construction materials, and enclosure detail and elevation, including landscape materials.

    (3)

    The plans, specifications and other data submitted under this section shall be in triplicate.

    (d)

    Setbacks . Dumpsters and enclosures may be exempt from all setback requirements, provided they shall not be placed within the visibility triangle or in other locations that could interfere with on-site/off-site traffic circulation.

    All dumpsters are required to meet the requirements of this section upon the effective date of this article.

    Exception: Properties which have previously been issued a permit for a dumpster enclosure and are kept in good, structurally sound condition and are aesthetically pleasing to surrounding properties as deemed by the public services director. If no permit was attained when the enclosure was built, it shall be brought up to the standards referenced in this section and in the city's dumpster enclosure standards at the cost of the property owner.
